Menakar Konstitusionalitas Putusan Mahkamah Konstitusi Nomor 62/PUU-XXII/2024 Tentang Penghapusan Presidential Threshold

Indonesia's presidential threshold, which requires the support of 20% of the House of Representatives seats or 25% of the national vote, has limited the choice of presidential candidates in the 2014-2024 elections, triggering transactional politics and a drop in the V-Dem democracy index from 79 to 87. The Constitutional Court's Decision Number 62/PUU-XXII/2024 which abolished this threshold triggered a debate on its constitutionality against the 1945 Constitution, democratic principles, and presidential stability. The purpose of this study is to examine the constitutionality of the decision and recommend electoral law reform for inclusivity without political fragmentation. The normative juridical method is used with legislative, conceptual (democracy, political rights), and case approaches (related Constitutional Court decisions), through a literature study of primary data (legal norms, decisions) and secondary (literature) data. The results of the study show that the constitutional Constitutional Court's decision is based on the open legal policy of the House of Representatives, expanding candidate participation, reducing transactionalism, and harmonizing citizens' political rights, despite the risk of fragmentation; recommended an adaptive threshold of 10-15% of the current national vote for the balance of presidential stability and multiparty democracy.
