Analisis Putusan Hak Asuh Anak Pasca Perceraian Dalam Perspektif Hukum Keluarga Islam

Divorce in Muslim households in Indonesia is on the rise, having a significant impact on child custody as stipulated in the Compilation of Islamic Law Articles 105 and 156, where priority is given to mothers for children under five unless they are not worthy, with the principle of child welfare; however, the practice of Religious Courts shows variations in classical fiqh interpretations that are less in tune with contemporary child welfare. The purpose of this study is to analyze post-divorce custody (hadanah) from the perspective of Islamic family law, identify gaps in classical fiqh doctrine with contemporary applications based on maqasid shari'ah (hifz al-nasl), and formulate recommendations for child protection. The juridical normative method uses legislative, conceptual, and case approaches through literature studies on KHI, fatwas, decisions of Religious Courts, and fiqh literature, analyzed qualitatively descriptive-analytical. The results show the etymological concept of hadana (caring), with conditional maternal priority; there is a shift in verdicts to holistic child maslaḥah, but there are still inconsistencies, so it is recommended to strengthen the maqasid shari'ah for uniformity and joint custody in order to optimize child welfare.
